The brief filed December 1, 2023, argues that imposing a damages bar under such circumstances would undermine the purposes of having the discovery rule, and would be particularly unfair to individual artists and small businesses lacking resources for continuous monitoring.

The brief filed June 21, 2024, urges the Supreme Court to grant certiorari because the Federal Circuit’s holding is based on an erroneous construction of Section 154(b).

The brief filed February 29, 2024, seeks clarity on what constitutes an unreasonable and inexcusable delay in prosecuting patent applications when applying the doctrine of prosecution laches.
REGENXBIO Inc. v. Sarepta Therapeutics, Inc.
The brief filed May 10, 2024, urges the Federal Circuit to reverse the district court’s Section 101 holding.
Professor Sheppard was also involved in the filing of over 25 comment letters in response to national and international administrative agencies requests for comment, including the USPO, FTC, WHO and the Copyright Office.
