The final decision regarding which types of cases and how many cases will be accepted by the Debtor Defense Clinic rests exclusively with the faculty supervisor. A non-exclusive list of facts that will be considered include: the capacity of the Clinic to take additional cases, the type of case for which legal representation is being sought, the Clinic’s expertise and ability to work on the type of case for which assistance is being requested, and the location of the case.
Cost of Services
There is no charge for attorneys’ fees. Clients may be responsible for any court-related filing fees or other legal costs imposed by the judicial system if those fees cannot be waived by the Court.
Eligibility Guidelines
The Debtor Defense Clinic does not have strict financial eligibility guidelines. However, the Clinic primarily accepts clients whose household income falls below 125% of the federal poverty guidelines and whose assets are of minimal value.
Even if applicants are financially eligible, the Clinic may not take a case if it does not fit a present educational need of the students. The faculty supervisor has final say over whether the Clinic will accept any particular case.
Service Area
Generally limited to Lancaster County, Nebraska, although the Clinic will consider filing bankruptcies for anyone domiciled anywhere in Nebraska.
