Professor Brandon Johnson has published “There’s ‘Clear Error’ in the Supreme Court’s New Racial Gerrymandering Decisions” on the Election Law Blog.

The essay discusses the Court's recent decision in Alexander v. South Carolina State Conference of the NAACP, in which the majority applied the clear error standard in a highly unusual way. The essay argues that this type of unusual application of law is becoming a worrying trend in the Roberts Court's election law jurisprudence.
