Immigration Guide


The Nebraska Criminal Law Practitioner's Guide to Representing Non-Citizens in State Court Proceedings is intended to help criminal law practitioners become familiar with the potential immigration consequences faced by their clients, and to be aware of possible strategies to minimize those consequences. Practitioners using the Guide will be in a much better position to advise their non-U.S. citizen clients about potential immigration consequences, and to assist their clients in mitigating such consequences to the extent possible.


The Guide is comprised of two main parts: (1) a 170-page overview of the U.S immigration system, the agencies that administer it, and the grounds of inadmissibility and deportability that are most often implicated by criminal proceedings; and (2) a tabbed appendix analyzing over 200 Nebraska criminal statutes for potential immigration consequences if a client is convicted under the statute in question. A companion CD-ROM is included that contains fully searchable text in .pdf format. Both the Guide and the CD will be updated on a periodic basis.
